IBARROLAART TERMS OF SALE
1. SCOPE OF APPLICATION
These conditions of sale regulate the purchase of products offered by IBARROLAART to its customers through the Website. IBARROLAART operates through the Website, nationally and internationally.
2. INFORMATION ON PRODUCTS AND SERVICES
The descriptions and photographs relating to the products offered on the Website are intended to provide as much information as possible to the customer. In the event that, due to circumstances of force majeure or any incident attributable to IBARROLAART, the product is not available after the purchase has been made, IBARROLAART will contact the customer to reimburse the customer for the corresponding amount.
3. PRICES OF PRODUCTS AND SHIPPING EXPENSES
The prices of the products offered through the Website include VAT and any other applicable taxes. For purchases made from/to the Canary Islands or other countries, VAT on the products will be automatically deducted at the time of purchase.
IBARROLAART reserves the right to change its prices at any time. The products will be charged to the customer at the advertised price at the time the order is posted.
4. PURCHASE OF PRODUCTS AND ORDER FORMALIZATION
For the purchase of products, the user must access the online store hosted on the IBARROLAART website where the products that can be purchased through the aforementioned channel are listed with the following information:
a) Product description, reference, features and photography.
b) Price per unit.
c) Shipping costs.
d) Conditions of validity of the offer, if applicable.
Once the product or products have been chosen, the user must add to the basket included in the website, indicating the units that they wish to purchase. Once the chosen products are added to the shopping cart, the user will be able to access the summary of the purchase, which must be accepted by clicking on the View Cart or on the cart icon at the top of the website, where the following information is detailed :
a) Product photo.
b) Product name
c) Unit price.
f) Total price of each of the products purchased.
g) Total purchase price.
h) Shipping costs and return policy.
The user must then provide their data. In the case of a registered user, you must provide the username and password assigned to the user. If the user has not previously registered, they must create an account on the website.
Once the user has entered their data, they will access Shipping Details, where they can review their shipping and billing data, modify them and request invoice (only for Spain). You will then access Confirmation of the shipment, where you will see the shipping and billing addresses of the same, the method of payment, accept the Terms of Purchase and proceed to your acceptance by clicking the "Buy" button.
After the purchase, IBARROLAART will send, within twenty-four (24) hours, an email acknowledging receipt and confirmation of the purchase made. The purchase of the Product will be deemed perfected at the time of receipt of the payment of the price by IBARROLAART
5. PAYMENT OF PRODUCTS
The Customer must make the payment by credit or debit card Visa, MasterCard, American Express, Visa Electron and/or other similar cards or through the Redsys POS system. The proof of purchase will be available and can be viewed in the My Account > Orders section. The card with which the payment is made must have as a financial institution to a Spanish bank or savings bank or to a branch or subsidiary financial institution of a foreign financial institution with establishment in Spain. The Customer must notify IBARROLAART of any improper or fraudulent charges on the card used for purchases on the Website in the shortest possible time, in order that IBARROLAART can make the necessary arrangements. The payment process works on a secure server using the Secure Socket Layer (SSL) protocol. In addition, IBARROLAART states that it does not have access to or store sensitive data relating to the means of payment used by the Customer. Only the corresponding payment processor has access to this data as a way of managing payments and collections.
6. CANCELLATION AND EXTENDING ORDERS
If the Customer wishes to cancel an order, he/she must proceed with its return, as indicated below. In case of order extensions, shipping costs may be increased which will be specified for each particular case. To cancel or extend the order, the Customer must request it by email to firstname.lastname@example.org. IBARROLAART reserves the right to cancel orders in cases and in accordance with the terms and conditions indicated in the "Payment of Products" section of these IBARROLAART Terms.
7. DELIVERY OF PRODUCTS
IBARROLAART will inform the Customer, before the end of the purchase process, of the delivery time of the Products. IBARROLAART does not deliver Products on Saturdays, Sundays, national holidays, regional and local holidays. IBARROLAART may inform the customer, by sending an email to his e-mail, the date of departure of the warehouses of the corresponding product order and the contact details of the transport company that will make the delivery. Within seventy-two (72) hours from that date, the product will be delivered to the address indicated by the customer, except in circumstances of force majeure. The delivery is considered to be made from the moment the product has been made available at the place of delivery indicated by the customer or at the corresponding collection point.
Place and conditions of delivery
IBARROLAART undertakes to deliver the product in perfect condition at the address indicated by the customer who, in any case, must be included within the Territory. In order to optimize the delivery process, the address indicated by the customer must be an address at which delivery can be made within normal business hours. If at the time of delivery of the product to the address indicated by the customer, there is no one, IBARROLAART will contact the Customer, indicating how to proceed to arrange a new delivery with the corresponding carrier. The customer must then contact the carrier as soon as possible to arrange delivery date. IBARROLAART guarantees the delivery of the Product during ten (10) calendar days following the date of the email sent by IBARROLAART informing the Customer that their order is on the way. If the delivery of the Product to the Customer has not been made within ten (10) calendar days indicated for reasons not attributable to IBARROLAART or the carrier, the products will be returned to IBARROLAART and the customer must take care of the shipping and return costs, as well as the associated management costs. The delivery address will be as indicated by the customer when making the purchase. IBARROLAART will not be responsible for errors or damages caused in the delivery when the delivery address entered by the customer does not exist, is incorrect or when the requirements for the change of delivery address indicated above are not met. At the time of delivery of the product, the customer or receiver must display an identification document to the carrier, check the apparent status of the packages and sign and write down on the delivery note (in the format presented by the carrier) the observations and apparent reservations at that time (e.g. lack of lumps or damage or apparent handling of products or packaging). If the packing slip is in paper format, the customer must request a copy of the packing slip from the carrier. In the event that, when opening the packages with the products, the customer sees that they are damaged due to transport, that they are incorrect or that products of the same order are missing, they must notify IBARROLAART in writing within five (5) calendar days from five (5) calendar days from delivery.
8. RETURN OF PRODUCTS
Right of withdrawal
The customer will have a maximum period of fourteen (14) calendar days from the delivery of the product to communicate its total or partial withdrawal from the purchase of the product, in accordance with the applicable legislation. After the end of the period of fourteen (14) days IBARROLAART will not accept returns for withdrawal of purchases of products. The refund made within the period will not incur any penalty. However, the customer must bear the shipping costs of the return. The product must be in the same state in which it was received, with the original labeling. The customer must send the product in the same box or envelope or in a similar format. In case the product is not shipped with the original packaging the product may suffer a depreciation.
The return process will be carried out via courier and you will be responsible for the return costs. In no case, we will accept returns sent in due shipping. We will not be liable for loss, delay or shipment to the wrong address of any product you wish to return to us, so we recommend that you send by registered mail or with acknowledgement of receipt. In addition, the customer will be responsible for proving that the items have been returned, so we recommend that it is always shipped by a system that certifies the delivery for their safety.

In the event of the exercise of the right of withdrawal, the customer will be entitled to reimbursement of the price of the returned products, in addition to the ordinary shipping costs (the difference in the costs of express shipping is not included), provided that the products returned are in the same conditions in which they were delivered, have not been lost before arriving at IBARROLAART units or the requirements set out in these Terms of Sale have not been met. IBARROLAART will refund the Customer the cost of the Product and the costs proportional shipping after the return costs are deducted. IBARROLAART will check in its warehouse the adequacy of the returned product, reserving the right not to make the refund in case of detecting that the product purchased and the returned do not match or that the return has not been made in accordance with these Conditions Sale. Partial returns of an order will result in refunds of the price and partial shipping costs. Shipping costs will be refunded proportionally to the value of the returned Product. IBARROLAART will manage the order to return the price and shipping costs using the same payment system used by the customer for the purchase of the products, within forty-eight (48) hours from the confirmation of arrival at the warehouse of the order returned and, in any case, no later than fourteen (14) calendar days since the Customer communicated his withdrawal. The application of the return price and shipping costs on the Customer's account or card will depend on the card and the issuing entity. The period of application of the refund of the price will be up to seven (7) calendar days for debit cards and up to thirty (30) calendar days for credit cards.
Return of Defective Products
The Customer shall be entitled to a refund of the price, shipping costs and return transport costs, defective products or products delivered if they do not correspond to the order placed by the customer, in accordance with the legislation Applicable. In the case of return of defective products, or that do not correspond to the order placed by the customer, IBARROLAART will be responsible for the costs of transporting the return of the products, provided that the return is made from within the.
9. COMPLETENESS AND MODIFICATION OF THE TERMS OF SALE

10. APPLICABLE LAW AND JURISDICTION
These Terms of Sale are governed by Spanish law. In the event of a dispute or disagreement arising from these Terms of Sale or the purchase of the products from IBARROLAART through the Website and for the resolution of any disputes, the parties agree to submit, at their own free choice, and waiving any other jurisdiction or jurisdiction to which they may be entitled, to the courts and tribunals of the city corresponding to the domicile of the client or user.
